Terms of Service

These terms govern use of nikolajocic.dev and managed WordPress infrastructure and security services provided through the platform.

1. Acceptance

By accessing this website, submitting contact requests, purchasing subscriptions, or using any related services, you agree to these Terms of Service and applicable laws. If you do not agree, do not use the services.

2. Services

Services may include managed WordPress infrastructure, security engineering, incident response assistance, consultations, and related technical support. Service scope, deliverables, timelines, and response expectations may vary by plan, agreement, or engagement specifics.

3. No Guarantee / Security Limitations

Cybersecurity and infrastructure hardening reduce risk but do not eliminate it. You acknowledge there is no guarantee of uninterrupted availability, complete threat prevention, or immunity from attack, data loss, third-party failures, misconfiguration by external parties, force majeure events, or business interruption.

4. Client Responsibilities

  • Provide accurate onboarding and account information.
  • Maintain lawful rights to all systems, domains, code, data, and content provided for service.
  • Maintain independent backups, compliance obligations, and business continuity planning unless explicitly contracted otherwise.
  • Promptly communicate incidents, access changes, and third-party vendor actions that affect infrastructure or security.

5. Acceptable Use

Services may not be used for unlawful, abusive, fraudulent, infringing, or malicious activity. Service may be suspended or terminated for abuse, nonpayment, legal risk, or conduct that threatens infrastructure integrity or other users.

6. Billing, Subscriptions, and Cancellations

Subscriptions are billed according to selected plan terms and payment processor rules. Unless otherwise stated in writing, plans are month-to-month. You may cancel recurring billing; access and service scope may continue through the paid period then end or downgrade. Fees already paid are generally non-refundable except where required by law or stated otherwise in writing.

7. Third-Party Services

Services may depend on third-party vendors (for example hosting, registrars, DNS/CDN, payment, email, monitoring, or cloud providers). Availability, performance, pricing, policy changes, and failures of those services are outside direct control and are not guaranteed.

8. Intellectual Property

Each party retains ownership of its pre-existing intellectual property. Client materials remain client-owned. Unless otherwise agreed in writing, provider methodologies, templates, tooling, and know-how remain provider-owned. Limited license is granted only as needed to deliver services.

9. Confidentiality

Reasonable efforts are used to protect confidential information disclosed for service delivery. Confidential information may be disclosed where required by law, court order, or to defend legal rights.

10. Disclaimers

Services and website are provided on an “as is” and “as available” basis to the fullest extent permitted by law. No express or implied warranties are made, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, liability for any claim related to services or website use is limited to the amount paid for the applicable service period giving rise to the claim. In no event will either party be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, loss of business opportunities, or loss/corruption of data.

12. Indemnification

You agree to defend, indemnify, and hold harmless nikolajocic.dev and its operators from claims, liabilities, losses, and costs (including reasonable legal fees) arising from your content, your infrastructure, your legal/compliance obligations, your misuse of services, or your violation of law or third-party rights.

13. Termination

Services may be terminated by either party according to plan terms or written agreement. On termination, access may be revoked, outstanding fees remain due, and provisions that by nature survive termination (including payment, IP, confidentiality, disclaimers, limitations, and dispute terms) remain enforceable.

14. Governing Law and Disputes

Unless a written agreement states otherwise, these terms are governed by applicable law in the service provider’s operating jurisdiction. Venue and dispute procedures may be specified in a separate signed services agreement and will control where conflicting.

15. Changes to Terms

These Terms may be updated at any time. Continued use after updates constitutes acceptance of revised terms.
